Hired managers were placed under house arrest in connection with fraud case
As Kommersant learned, three defendants appeared in the criminal case of fraud. At the request of investigators from the Main Investigation Department of the Main Directorate of the Ministry of Internal Affairs for Moscow, the Tverskoy District Court of the capital placed under house arrest three managers who, on behalf of the LLC, entered into loan agreements with the company’s clients. The leaders of the latter hid from clients, stealing more than 2.5 billion rubles, received under the promise of high payments. The defense believes that the girls, one of whom even quit the brokerage firm before his management committed crimes, simply decided to make them extreme in this high-profile story.
The Ministry of Internal Affairs for the Central District (CAO) of Moscow opened this criminal case back in August 2021 under Part 4 of Art. 159 of the Criminal Code of the Russian Federation (fraud on an especially large scale) against unidentified persons. Then the defendants were identified: it turned out that about a year earlier, Alexey Mustafin and Alexander Dribenets, who had previously been convicted of fraud, entered into a criminal conspiracy and organized the Financial Broker LLC office on Lev Tolstoy Street, 5/1, which is three houses from the prosecutor's office and the department of the Investigative Committee for the Central Administrative District, raising funds from citizens for loans with high interest rates, supposedly for investment in profitable projects, and then they stole the money. Based on these facts, 231 criminal cases were initiated, then they were combined into one proceeding.
Now there are about 750 victims in the case, who suffered damage in the amount of 150 thousand to 3.7 million rubles. And in total, according to the claims filed by the Financial Broker clients themselves, they were deceived by 2.5 billion rubles.
Despite the scale of the fraud, the police actually missed their organizers. On April 22 last year, Alexey Mustafin was summoned to the Ministry of Internal Affairs, where he was interrogated for the first time as a suspect - seven months after the first fraud case was opened. However, despite the fact that the defendant was facing a ten-year sentence, the investigator immediately released him on his own recognizance and proper behavior. When the investigation caught sight of Alexei Mustafin in May, the suspect had already disappeared and he was put on the wanted list. And a month later, in June 2019, Alexander Dribents was put on the wanted list, who also disappeared in an unknown direction. They were never found, although, according to the testimony of some witnesses, Alexander Dribenets continues to collect money for a new fraudulent project, now in Crimea.
Such an investigation, naturally, did not satisfy numerous victims in the case, who filed complaints about red tape and violation of all possible reasonable deadlines for the investigation to the leadership of the Russian Ministry of Internal Affairs and the Prosecutor General's Office. As a result, the case was transferred from the district police to the Main Directorate of the Ministry of Internal Affairs for Moscow, whose investigators, as noted by victims and lawyers, instead of intensifying the search for the escaped organizers of the fraud, detained three hired managers of the company, whom the Tverskoy District Court placed under house arrest.
Unlike Alexey Mustafin and Alexander Dribents, the women had previously regularly attended all investigative actions, talking in detail about their work at the LLC.
According to investigators, three female managers also participated in a criminal scheme aimed at fraudulently stealing citizens’ funds, since it was they who, on behalf of the “Financial Broker,” entered into loan agreements with clients, which means, as investigators believed, they were also “in share” times they promised to fulfill obviously impossible obligations under contracts.
“This position of the investigation is erroneous and is completely refuted by the evidence collected in the case,” believes, in turn, lawyer Mikhail Osherov, representing one of the prisoners, Irina Kolentseva. According to him, the managers did not have access to the funds received under the loan agreements, did not manage them and did not determine how to spend them, but simply fulfilled their duties in accordance with the employment contracts concluded with them, without knowing the real financial situation of the LLC. “In fact, they, just like the defrauded investors, were misled about the criminal activities of the company’s leaders,” says defense attorney Osherov.
The managers, he noted, entered into loan agreements not on their own behalf, but on behalf of the “Financial Broker” on the basis of a power of attorney. At the same time, they did not and could not bear personal responsibility for the return of borrowed funds to the lenders, since, according to Art. 807 of the Civil Code of the Russian Federation, it is assigned to the LLC, which the defendants did not manage. The managers could not verify the authenticity of the company's management's promises, since they did not have access to the company's financial documents and did not keep its accounts.
It should be noted that it worked successfully for ten years, from 2007 to 2021; loan arrears began only after that.
According to the defense, the managers, seeing how from year to year the LLC’s regular clients enter into loan agreements and consistently receive good interest rates on them, could not foresee that with the arrival of the new director Mustafin, the company could go bankrupt and its obligations would not be fulfilled. Moreover, lawyer Osherov noted, Ms. Kolentseva left the company in December 2016, before Alexey Mustafin joined it, that is, before the period of criminal activity began.
Currently, only one of the LLC’s managers, Alexey Mustafin, is being charged in a criminal case in absentia (Alexander Dribenets was the founder of the company). However, in addition to him, in 2017–2018, four more people acted as general directors of the Financial Broker, but the police did not give a legal assessment of their actions, unlike female managers.
